It depends on your nationality, family and assets. Your national law may give you more freedom; Spanish law may suit some families better. We explain both options with your real situation.
Yes. Spanish open wills are kept by the notary and only their existence is recorded in the Central Registry of Last Wills. The content is only released after death to those with a legitimate interest.
It is strongly recommended. A foreign will can be used in Spain, but it must be apostilled, translated and backed by proof of the foreign law — which delays the inheritance by months and costs your heirs far more than a Spanish will.
If Spanish law applies, part of the estate is reserved for children (the legítima). But as a foreign national you can choose the law of your nationality in your Spanish will; for many British clients, for example, that means full freedom to leave assets as they wish.
